Minor car accident (not at fault) - should I go to my insurance or small claims court?

I was wondering if anyone could give me some advice. Last week I was involved in a minor car accident. I was at a stop light and the car behind me decided they could not wait and they tried to get by my car to make a left turn. They did not have enough room and scraped against my car with theirs. No one was hurt and no police were called. We pulled over and I got their name, phone number and address. They did not give me their insurance information and said they'd like to settle outside insurance because there are only scratches. I know it was stupid but I said okay. Also I do not have the license plate number of the car. I thought I wrote it down but I did not (I understand this is a big mistake on my behalf). We made contact over phone throughout the week and discussed repairs but suddenly they stopped answering my calls. I believe they are avoiding me. Now I am at a loss of what to do. Should I take this issue up with my insurance (at the risk of raising my premiums) or should I take this to small claims court? In either case I do not have the car's license plate so if it isn't their car will that be insufficient evidence to prove they are at fault (my word against theirs)? Long story short (hopefully)...My 17 yr old step-son got his license just after his b-day last yr and my husband stupidly bought him an undeserved car (we have had nonstop issues with him for over 2 yrs with his disrespectful and insulting/criticizing attitude, refusing to follow house rules, his very poor, negative and selfish behavior on top of his constant lies and his drug and alcohol use and continues to bring it around my 4 yr old son). He completely trashed the car, it reeked of cigarettes and pot, we found empty beer cans and other cans used to smoke his pot. We took the car away and cleaned it the best we could and after a few months of him still continuing his behavior and habits we sold the car. He bullies his mom and sister (always has) and took his moms keys and her car from her and will not return it. I know we are legally responsible for him until he turns 18 which isn't too much longer BUT he is getting worse with everything, my husband has given up on him and just lets him come and go as he pleases and do what he wants (he claims he will kick him out on his bday but no one believes him b/c of many past threats not followed through and his kids know it so they continue to play him), I'm told to stay out of it because he isn't my son yet he is still on MY insurance and driving his mom's car while drinking and smoking pot and continuing not to follow the law with his restrictions either. I can't wait for this ungrateful punk to be out of my house. He constantly badmouths all of us with lies to everyone and blames us when things don't go his way. He has always been extremely lazy and does not want to work, he keeps forcing his mom to give him money which she does b/c she claims she is afraid of him, he has NEVER helped with anything around the house, he has already been in trouble a few times with the police as young as 12 when he wouldn't follow skateboarding rules. I'm being low balled by an insurance claims adjuster for damage to my car, now what?

I had a claim against a guys insurance company for damage he caused. They came out today and did an evaluation and now the insurance estimator is saying that the vehicle needs to be totaled and that I will be offered some low ball figure because my car has prior damage which was only cosmetic and minor nothing structural at all. I know that the vehicle will be worth more than they are going to offer. But I just want a fair price for the car. They suggested that it might take some back and forth negotiations and I need to know how to prepare for that and succeed at getting something fair? Is this insurance company giving me the runaround?

I filed a claim with USAA on September 5th on a hit and run accident in which the police were able to find the person and get his insurance. He called them and said he didn't do it - and I hit him. I called, gave my side of the story and the number of the police who were handling the accident. They always say they will call me back and they don't - so I call them in which they give me another date they will get back to me. They never ONCE have gotten back to me. The policy holder who hit me is now in jail on an unrelated offense and they say they cannot get his statements - duh. They say they will contact the police and get back to me - but they never have. The damage to the car isn't that much - it is $416 (just a headlight) but I cannot afford to pay for it. Putting it through my insurance is dumb because the deductable is $500 - at least I think that is how it works. Could you give me advice on how to deal with USAA? I can't talk to them on the weekends because they say they can't handle my existing claim. I'm getting REALLY frustrated.
